Agreement
These Terms of Service (the “Terms”) are an agreement between you and Nu Projects LLC, doing business as Jewful (“Jewful,” “we,” or “us”), covering Jewful's website, ticketing, event and community features, and communications (the “Services”). By using the Services or buying a ticket, you agree to these Terms, our Privacy Policy, and, if you receive texts, our SMS Terms.
Events on Jewful are organized by the organizations named on each event page (“Organizers”). Organizers are responsible for their events. Jewful provides the ticketing and community tools.
Eligibility and accounts
You must be at least 18 years old to use the Services. An event may set its own age requirement, and you are responsible for meeting it.
You sign in with a one-time code sent to your email address or mobile number. Keep access to them secure; you are responsible for activity in your account. Give accurate information, including your name, which may be checked at the door.
Buying tickets
- Jewful processes payment for tickets sold on Jewful through our payment processor, Stripe, and collects any sales or admission tax due. The total, including tax, is shown before you pay. Jewful does not currently add a service or processing fee.
- When you continue to payment, your tickets are held for 30 minutes. If you do not pay in that time, the hold ends and the tickets may be sold to someone else.
- You can use one discount code per order. Codes are set by the Organizer, may expire or run out, and have no cash value.
- An order is complete when payment succeeds and you see your confirmation. Completed orders can still be cancelled, as described in “Our right to cancel tickets” below.
- Tickets are for personal use. Reselling tickets for more than their face value is not permitted, and Organizers may cancel tickets that are.
Refunds and event changes
Tickets are non-refundable unless the Organizer or Jewful chooses to issue a refund. If you can no longer attend, you can transfer your ticket to someone else through Jewful at no charge (see “Guest tickets and transfers” below).
If an event is cancelled and not rescheduled, you will receive a full refund of the ticket price and any tax you paid. If an event is rescheduled or its venue changes, we will notify ticket holders, and your ticket remains valid for the new date or place unless the Organizer offers refunds.
Refunds return to your original payment method and usually appear within 5 to 10 business days.
For any refund question, contact the Organizer or use our contact form.
Our right to cancel tickets
Jewful may cancel any ticket or order, or refuse to sell one, at any time, for any reason or no reason, at our sole discretion, including after your order is complete and after a ticket has been sent to a guest or transferred. For example, we may cancel tickets we believe were bought by fraud, with bots, or for resale, that exceed an event's ticket limits, or whose holder we believe would pose a safety risk, but we are not required to give a reason. A cancelled ticket no longer admits anyone.
Guest tickets and transfers
If you buy more than one ticket, you can name a guest for each extra ticket or send them a private claim link. A guest who claims a ticket controls it in their own Jewful account. You can also transfer a ticket to someone outside your party, at no charge. Once a ticket is claimed or transferred, its earlier QR code stops working. Anyone with a claim link can claim that ticket, so share links only with the intended person.
Admission and check-in
Your ticket's QR code, or the 12-character code beneath it, admits one person once. A screenshot works. Event staff may ask for identification and may refuse entry under the Organizer's policies, for example for age requirements or conduct. A ticket that has been refunded, cancelled, or transferred is not valid for entry.
Organizers
Organizers set their event details, prices, ticket limits, and policies, and are responsible for running their events safely and lawfully. When you buy or claim a ticket, the Organizer receives your contact details and ticket information, as described in our Privacy Policy, and may email you about the event. Organizers may send you promotions only if you opt in, and you can unsubscribe at any time.
Acceptable use
Do not misuse the Services. For example, do not use bots or scripts to buy or hold tickets, guess discount or ticket codes, interfere with the Services or other people's use of them, access accounts or data that are not yours, or use the Services for anything unlawful.
Your content and ours
You keep ownership of what you submit, such as an event profile. You give Jewful a non-exclusive, royalty-free permission to use it to operate and improve the Services, for example to suggest pregames and to show your profile to other attendees of the same event who have also joined its social experience. Jewful's name, logo, and software belong to Jewful, and event content belongs to its Organizer.
Disclaimers and limits of liability
The Services are provided “as is.” To the fullest extent the law allows, Jewful disclaims implied warranties, and Jewful is not responsible for an Organizer's event, for what happens at it, or for the conduct of other attendees.
To the fullest extent the law allows, Jewful is not liable for indirect, incidental, special, consequential, or punitive damages, and Jewful's total liability for any claim relating to the Services is limited to the greater of the amount you paid Jewful in the 12 months before the claim or $100. Some jurisdictions do not allow these limits, so they may not apply to you.
Disputes and governing law
Please read this section carefully. It requires you and Jewful to resolve disputes through individual binding arbitration instead of in court, and it waives the right to a jury trial and to bring or join a class action.
Informal resolution first. Before starting arbitration, the party with a dispute must send the other a written description of it and the relief sought (to Jewful through its contact form), and both parties will try in good faith to resolve it for 60 days.
Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator, not a court, decides questions about the scope and enforceability of this agreement to arbitrate. Arbitration may take place by video, by phone, on written submissions, or in person in the District of Columbia or the county where you live. Payment of filing and arbitrator fees is governed by the AAA rules. The Federal Arbitration Act governs this section.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek a court order to stop infringement or misuse of intellectual property or unauthorized access to the Services.
Class action and jury waiver. You and Jewful may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may award relief only to the individual party and only to the extent needed for that party's claim. You and Jewful waive any right to a jury trial.
Opting out. You may opt out of this arbitration agreement by writing to us through our contact form within 30 days of first accepting these Terms, with your name and the email address or mobile number on your account and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
If part of this section is unenforceable. If the class action waiver is found unenforceable for a claim, that claim must be decided in court and not in arbitration, and the rest of this section still applies to other claims. Disputes decided in court, and anything not covered by arbitration, will be heard only in the state or federal courts located in the District of Columbia.
Governing law. These Terms are governed by the laws of the District of Columbia, without regard to conflict-of-law rules, except as the Federal Arbitration Act provides above.
Changes and contact
We may update these Terms as the Services change. We will post the new Terms here and update the date above, and for material changes we may also notify you by email or through the Services. Changes apply going forward; the Terms in effect when you bought a ticket govern that purchase. Questions? Use our contact form.
Social features and conduct
Pregames, event profiles, and other social features are optional. Joining them never affects your ticket. When you take part, be respectful: no harassment, hate, threats, discrimination, impersonation, unwanted sexual contact or messages, or sharing other people's personal information without permission. Meet in public places and use your own judgment; Jewful does not screen attendees.
We may remove content or restrict or close accounts that break these rules, and an Organizer may refuse entry for conduct. Report a concern through our contact form.
